Safety Gate Defects & Entrapment Risks: Aborder Cumbor Retractable Safety Gate Recall & Product Liability

In almost every household where young children reside, safety gates have been present to ensure the safekeeping of young toddlers who might be exposed to dangerous areas of the home. However, the U.S. Consumer Product Safety Commission (CPSC) issued an announcement in January 2026 concerning the recall of the Aborder Product brand of Cumbor retractable safety gates, which can cause injury or even death. 

What does the recall cover? 

This product recall includes Cumbor-branded retractable safety gates with a metal frame and mesh screen approximately 34 inches high and adjustable up to 55 inches wide. The product was sold online, mostly on Amazon, at the end of 2025 for around $40.

According to the CPSC, the gates fail to comply with mandatory safety standards concerning expansion and expandable enclosures. The risk associated with the recalled gates is that a young child’s torso will fit between the gap where the floor meets the gate, posing a risk of entrapment, which may result in serious injury or death should a trapped child be unable to breathe or escape.

Consumers are advised to stop using the gates immediately, destroy the gates by cutting the mesh, and contact the company for a full refund. 

Understanding the danger 

Entrapment risks offer a uniquely frightening scenario in product safety. The product is intended to protect the child from harm, yet it can actually harm the child. According to safety experts and previous recall history, the gap in safety gates can cause entrapment of the head, torso, or limbs of the child. This can result in crushing, asphyxiation, or other injuries to the child. Even in the absence of reported injuries, the potential for harm is extreme.

Other recalls of similar gates sold by other retailers have also been related to entrapment and fall injuries. This highlights the prevalence of such defects in the gates that do not meet the CPSC’s standards. 

Product liability and dangerous children’s products 

Recalls such as this one offer a window into product liability rules, where the responsibility of the manufacturer, distributor, and sometimes even the retailer, is implicated for injuries caused by defective or harmful products. There are several theories of product liability applicable to defective safety gates. 

  • Design defect – A safety gate must be intrinsically safe in terms of its intended use, which is to restrict the movement of toddlers and deny them access to potential dangers. If the product’s design includes openings that can entrap a child, it is intrinsically defective for its intended use. 
  • Manufacturing defect – In some cases, the manufacturer made a mistake that renders the gate dangerous for its intended use. When this is the case, the manufacturer can be held liable for injuries. 
  • Failure to warn – Manufacturers have a duty to inform customers of potential dangers related to their product. When they fail, they can be held liable.

Plaintiffs in product liability claims do not need to prove negligence. They simply need to demonstrate that the product was defective and that they were harmed by the defect. The fact that there is a federal recall is evidence that the product is defective.
