Death on the High Seas Act

If your loved one was involved in a fatal accident while aboard a cruise ship, you may have a cause of action to pursue damages against the cruise line under the Death on the High Seas Act. As found in 46 U.S. Code Section 30302. Cause of Action, the personal representative of the decedent may bring a claim for civil damages against the person or vessel responsible for the death when the death was caused by the “wrongful act, neglect, or default occurring on the high seas beyond three nautical miles from the shore of the United States.”

Under the act, the personal representative can bring a claim for the pecuniary damages—that is, the economic damages suffered by the individuals for whose benefit the action is brought (i.e. the surviving spouse or children of the decedent). Noneconomic damages are not recoverable under a Death on the High Seas Act claim.
