Early Learning Center Recalled Due To Choking Hazard

Cube_Red

Early Learning Center Little Senses Lights & Sounds Shape Sorter toys have been recalled due to a choking hazard posed by one of the shapes that toddlers can sort. The toys were sold exclusively on Amazon.com. According to the Consumer Product Safety Commission, a red cube, which is one of the shapes that can be sorted, can detach exposing a white ball that poses a potential choking hazard to infants and toddlers. The toy was marketed to children ages 6 months to 36 months old. It holds six colored shaped pieces with lights and makes sounds and music.

According to the manufacturer, customers should immediately take the recalled toys away from children, stop using the recalled red cube, discard the red cube, and contact Addo Play for a free replacement red cube. Thus far, no injuries have been reported in the U.S. related to the product. However, choking hazards represent a serious threat to young children and product liability lawsuits against vendors and manufacturers can happen when a child chokes on a toy.

Choking hazard lawsuits

Choking hazard lawsuits are a type of product liability lawsuit. In most cases, these lawsuits are filed by parents whose children were injured due to a dangerous or defective child’s toy. A product liability lawsuit is a type of case that involves a claim over a defective product. When a child is injured by a defective toy, their parents may file a lawsuit to recover damages related to past and future medical expenses as well as pain and suffering damages. In the event that the child is killed due to a defective toy, the parents can file a wrongful death lawsuit against the manufacturer, seller, retailer, or distributor.

In a choking hazard lawsuit, the plaintiff alleges that the defendant failed to adequately warn their customers about a potential choking hazard. In most cases, choking hazards fly under the radar as manufacturers are acutely aware of potential defects related to their products. In the case mentioned above, you have one part of the overall toy that could become detached creating a potential choking hazard. It is more than likely that the manufacturer was not aware of this defect prior to entering the product into the stream of commerce. Luckily, it was recalled before the defective product could injure any children.

In a failure to warn lawsuit, the plaintiff must establish that:

  • The defendant either knew or should have known about a product’s danger
  • The defendant had a duty to warn its customers about the danger
  • The defendant breached their duty to warn customers about the choking danger
  • A plaintiff was injured or killed because of the choking hazard
