Injury Hazard Results In Recall For Handrails

The U.S. Consumer Product Safety Commission (CPSC) recently announced the recall of Samven Technology’s Vevor Handrails due to an injury hazard. According to the CPSC, the handrails’ welding can fail while the consumer is holding onto the handrail. If this occurs while the consumer is stepping down a flight of stairs, it can pose a serious fall hazard.

Consumers are advised to immediately stop using the recalled handrails and contact Vevor for a full refund. Vevor will provide pre-paid shipping labels for consumers to return the product. As an alternative, consumers can provide photographic evidence of disposal or destruction at recalling@vevor.com. Vevor is also contacting all known purchasers directly.

The recall indicates that Vevor has received five reports of the handrails breaking, resulting in injuries. One of these injuries was a head injury.

The handrails were sold at:

  • Amazon.com
  • eBay.com
  • HomeDepot.com
  • Lowes.com
  • Vevor.com
  • Walmart.com

They were sold between February 2020 through November 2024 for between $57 and $109.

Understanding defective handrail lawsuits 

Several lawsuits have been filed regarding defective handrails on stairs. Such lawsuits are filed either under the theory of premises liability or product liability.

In terms of premises liability, a property owner has a duty of care to maintain their property in good repair. If a defective handrail causes an individual to fall down stairs, the owner of the property where the victim fell could be held liable if the stairs were in a state of disrepair.

In the case mentioned above, you have an example of a defective product with welding issues causing head injuries to members of the public. In that case, the injured party would file a lawsuit under the theory of product liability.

Examples of defective handrail problems 

  • Loose or unstable rails – If a handrail is not properly attached to a wall or structure, it can easily detach when someone relies on the handrail for support, leading to a fall.
  • Insufficient strength – Handrails are expected to withstand a certain amount of force. According to OSHA, a handrail should be able to support at least 200 pounds. If the handrail breaks or gives during anticipated use, it would be considered defective. The handrails recalled above are a prime example of a defective handrail.

Ultimately, if a company manufactures a defective handrail, they are responsible for any injuries it causes. In addition to the manufacturer, the retailer who sold the handrail (such as Amazon or Walmart) can be held liable for placing the defective handrail into the stream of commerce.
