Florida Toy Injury Attorney

When parents, caregivers, friends, or family members purchase toys for young children, they should not have to fear that the toy will result in a severe or fatal child injury. However, toys are more dangerous than you might think, and serious defects can have devastating results. Toys can cause injuries when they have design or manufacturing defects, and the makers of these products can be liable for damages. Companies that sell toys can also be responsible for injuries when they fail to warn about risks associated with the product, such as small objects that are inappropriate for children of a young age or sharp objects that can cause laceration injuries. If your child was injured by a toy product, you should seek advice from one of our Florida toy injury attorneys.

Learning More About Florida Toy Injuries

Do toys really cause serious and deadly injuries to kids? According to the Children’s Safety Network, there were more than one million child injuries caused by toys between the years 2015 and 2018. Of the injuries that required medical treatment, the most common types of injuries cited were the following:

  • Lacerations;
  • Contusions;
  • Abrasions;
  • Fractures;
  • Strains or sprains;
  • Internal injuries; and
  • Foreign body injuries.

Statistically, more male children require treatment in emergency departments for toy-related injuries than female children. Indeed, male children account for more than 65 percent of all toy-related injuries treated in emergency departments, while female children account for nearly 35 percent of those injuries.

Types of Toys Commonly Cited in Child injuries

What types of toys most often have defects or cause child injuries? The Children’s Safety Network cites the following as the most common causes of toy-related injuries:

  • Skateboards;
  • Stand-up scooters;
  • Balls;
  • Toy vehicles; and
  • Building sets.

It is important to remember that children of different ages can experience different types of toy-related injuries. Young children are much more likely than older children to swallow small toy parts and to experience choking injuries, for example.

Toy Injuries and Florida Product Liability Lawsuits

When toys cause serious injuries, what kinds of claims can be filed? Generally speaking, there are three different types of product liability lawsuits that may be appropriate based on the facts of your case:

  • Design defect lawsuits, or a claim against the designer of the toy or one of its parts, which can happen when there is something inherently wrong with the design of the toy;
  • Manufacturing defect claims, which are appropriate in cases where the toy or one of its parts developed a defect in the manufacturing process even though the design is sound; or
  • Marketing defect, which is also known as a failure to warn claim, which may be appropriate in situations where the retailer of a toy fails to warn about risks associated with intended or foreseeable uses of the toy.
