Catheter Device Blamed For Injuries To Patients

IVPort

Bard PowerPort is a catheter device that is implanted just below the skin. However, some claim that the device is intrinsically defective, prone to breaking off, and then small metal shards can migrate throughout the bloodstream causing a significant risk of injury. According to plaintiffs, the device has a design flaw that makes it more likely to fracture and migrate in the bloodstream.

Those who have suffered significant injuries due the Bard PowerPort catheter are now forming a class to file a lawsuit against the company.

Defective medical device lawsuits

Defective medical device lawsuits are filed under a theory of product liability. In cases where a product does not work as advertised, a lawsuit can be filed when the product causes serious injury. In these cases, the defective medical device fractured in the bloodstream causing clots, infections, and other potentially deadly symptoms.

Lawsuits such as these are filed under a theory of strict liability. That means that the plaintiff does not need to establish negligence in the lawsuit to recover damages. They need only establish that an injury occurred in the anticipated use of their product.

Analyzing the Bard PowerPort catheter claims

The Bard PowerPort Port, also known as a PowerPort is a medical device that operates as a port or catheter system. It is designed to help deliver drugs repeatedly into a patient’s vascular system. It can deliver medication, IV fluids, blood products, and more directly into the bloodstream. The device is surgically implanted underneath the skin.

Structurally, the device is composed of two elements: a catheter and an injection port. The injection port has a raised center where a needle would be inserted to deliver medication. The medication travels through a flexible tube (the catheter) where it enters the bloodstream. This device is used for patients who require routine injections. It is considered safer, in most cases, than repeatedly injecting medication without the use of the device.

However, pieces of the device can break off and enter veins and arteries where they create clots and infections. This can cause severe injury to patients. The biggest risk is that the catheter can fracture creating debris in the patient’s bloodstream. This can lead to Deep Vein Thrombosis, a condition characterized by blood clots forming in the veins.

With a growing number of injured plaintiffs, the lawsuit looks ready to assert that the catheter was designed defectively for the purpose of delivering drugs into the body. If so, then the plaintiffs will be entitled to recover damages related to their injuries.

How much money they will recover will depend on the severity of their injuries. In cases like these, it’s possible that someone sustains a permanent injury as a result of the catheter malfunctioning. If so, then the stakes get very high for the company that manufactured the defective medical product.
