Baby Activity Centers Sold At Walmart Recalled Due To Risk Of Injury

The U.S. Consumer Product Safety Commission and Dorel Juvenile Group, the manufacturer of Cosco Jump, Spin, & Play Activity Centers, have announced a recall of the product due to a risk of injury, according to a recent report issued by CPSC. The products were sold exclusively at Walmart. According to reports, the straps attached to the seat can detach, possibly causing falls and a significant risk of injury to children. The recall came after there were 141 reports of detached straps and 38 reports of minor injuries ranging from bumps and bruises to minor lacerations. Parents who purchased the product have been issued recommendations to immediately stop using it. The activity centers were sold between November 2020 and October 2023 for about $70 apiece.

Walmart toy injury lawsuits

Walmart, as well as the manufacturer, can be held liable if any of the products that they sell cause injury to children. In these cases, plaintiffs can file product liability lawsuits against the retail giant for placing a dangerous product into the stream of commerce. In this case, no serious injuries were reported, but there were several close calls, according to reports. The straps that held the baby into the activity center could detach causing a significant risk of injury. Most of the reported injuries were minor scrapes and bruises resulting from falls out of the activity center.

Holding product manufacturers accountable for dangerous products

The manufacturer of a product is often strictly liable for any injuries that occur in the course of the normal use of the product. In this case, parents were blindsided by the defective straps that caused falls to their children. The parents could have in no way predicted that the straps would break and potentially injure their children. Therefore, the manufacturer is liable for any injuries that occur.

At present, there are no reports of lawsuits filed against the manufacturer or Walmart related to this product. It is likely that the injuries incurred as a result of the product’s failure were not significant enough to warrant filing a lawsuit. The company has agreed to replace the product as part of the recall. Parents are instructed to cut the straps of the product and send Dorel a picture of the product with the cut straps for a free replacement.
