The superb weather in South Florida, with the warm climate and sun nearly every day, make the area an ideal spot for water sports and swimming pool activities. The state of Florida is ranked number one in the country for injuries and deaths related to swimming pool accidents with thousands of serious injuries and deaths occurring every year. This can be for any number of reasons, such as a slippery spots next to the pool, an edge that is too sharp, an area being shallower than labeled or a piece of a fence around the pool missing or damaged.
Regrettably, young children comprise the largest percentage of these injuries and deaths. It is estimated that over 1,300 children die as a result of swimming pool accidents every year. Oftentimes, children drowning are the result of the failure to supervise the pool area. Accordingly, many of these injuries and deaths could be prevented had the swimming pool owners or managers maintained their swimming pools in a reasonably safe manner.
A swimming pool accident, like any other accidents creates the potential for liability of different parties. Swimming pool cases usually involve either a pool that was constructed improperly or a pool that was not supervised sufficiently. Depending on the case, different parties may be liable. For example, a pool may have a faulty drain, which creates too much suction and can trap swimmers. If this is the case, then the company who designed the pool may be held liable. On the other hand, if a hotel pool fails to have a lifeguard in place during open pool hours and someone drowns during this period, the owner of the pool (i.e. the hotel) may be held liable for that death.
